Ogden was exempt from a <br /> solid waste facilities permit and Regional Water Quality Control <br /> (RWQCB) permit as long as Ogden treated only "on-site" contaminated <br /> soils from the Tillie Lewis property. <br /> When Ogden receives "off-site" contaminated soils this department <br /> considers that a significant change and permits from California <br /> Integrated Waste Management Board (CIWMB) and RWQCB are required. <br /> Ogden claims that it is exempt from CIWMB permit but not from RWQCB <br /> permit. <br /> If a CIWMB solid waste permit is required then San Joaquin County <br /> Public Health Services, Environmental Health Division (EHD) would <br /> be the lead enforcement agency. <br /> On July 31, 1990 Ed Padilla, Senior Registered Environmental Health <br /> Specialist met with Carrie Cummings, Forward Inc. , Wendy Lessig, <br /> Ogden, and Robert Wilbourn, Ogden. At that meeting the Ogden <br /> management team was informed that a CIWMB permit will be required <br /> if "off-site" contaminated soils are accepted. <br /> On September 12 , 1990, staff received a report that Ogden was <br /> receiving "off-site" contaminated soils. On September 13 , 1990, a <br /> Cease and Desist order was issued by EHD to Ogden for receiving <br /> "off-site" soils. <br /> On September 21, 1990 PHS received a letter from CIWMB requesting <br /> that the Cease and Desist Order be amended to extend the effective <br /> date of the Order to October 12 , 1990. This extra time was needed <br /> ^ to give state legal counsel time to review the Ogden project and <br /> decide the question if whether a CIWMB permit would be required. <br /> A Division of San Joaquin County Healh Care Services 0 <br />
