10/12/90 15:30 PM&54774751 N*4 P007i0e8
i
Mr. Donald Dier
September 13, 1990
Page 6
like the facilities listed in paragraph 2, the Tillie-Lewis
Facility producoa a commmnercially valuable product from
material that would oth:rwise have been discarded as waste .
In light of t e statutory definition of "solid
waste" and the regulato examples of facilities that are
not "solid waste facili ion, " there can be little doubt that.
the Tillie-Lewis Facili y is not a solid waste facility.
Consequently, a solid waste facility permit is not required,
in connection with the operation of the Facility.
Nonetheless , County Health Services has issued a Cease and
Desist order precluding the Facility from accepting
contaminated soil (attahed) . This order effectively shuts
down the Facility. Con quently, time is of the essence in
resolving this matter, nd your concurrence with our
conclusion would be greatly appreciated.
We would apprciate an opportunity to meet with
you to further discuss this matter. I will contact you
early in the week of September 16 so that we can discuss
arrangements to meet at your earliest convenience. In the
meantime, should you have any questions about our position
or the operation of the: Tillie-Lewis Facility, please do not
hesitate to contact me. I look forward to hearing from you..'
I
I
Sincerely
yours,
G0
;
Gary 11. Amato
cc : Maureen C.
