Box 5018 <br /> Modesto CA 95352 <br /> UNDERGROUND STORAGE TANK CLEANUP FUND PROGRAM, REQUEST FOR ADDITIONAL <br /> DOCUMENTATION: CLAIM NUMBER 010323; FOR SITE ADDRESS: 16865 Gawne Road, <br /> Stockton CA 95205 <br /> After reviewing your claim application received June 21, 1995, we find that the following <br /> additional information is'needed to determine Mr. Moresco's eligibility for placement on the Priority <br /> List: <br /> 1 . Verification from the local regulatory agency that an unauthorized release of petroleum <br /> from the underground storage tank was discovered on a specified date. <br /> 2. A copy of the Estate's income tax returns for the last three years. This is needed to <br /> verify the Priority Class B (small business). Please submit complete, signed and dated <br /> copies of the fiduciary income tax returns (Form 1041) as well as the Schedules (A, D, K, <br /> etc). <br /> 3. We cannot find evidence that a permit was obtained by January 1, 1990, to own and <br /> operate the underground storage tank. Claimants who were subject to the permit <br /> requirement but failed to comply by January 1, 1990, can request the State Board to <br /> waive the requirement as a condition for eligibility. Where the State Board does waive <br /> the requirement, the deductible is increased from $5,000 to $10,000. To request a <br /> waiver, all of the following criteria must be met and supporting documentation submitted: <br /> a. The claimant was unaware of the permit requirement prior to January 1, 1990, and <br /> there was no intent to intentionally avoid the permit requirement or the fees associated <br /> with the permit. <br /> Provide a brief history of the tank(s) and an explanation as to the reasons the tank(s) <br /> were not permitted by January 1, 1990. Identify when and how the claimant became <br /> aware of the law requiring a permit to own or operate the tank(s). <br /> b. Prior to submittal of the claim application, the claimant has complied with the financial <br /> responsibility requirements of Section 25299.31 of the Health and Safety Code. <br /> Completion of the Claim Application, Section X, Financial Responsibility, and the submital <br /> of the documentation requested for that Section should be sufficient to meet this <br /> requirement. <br /> c. Prior to submittal of the claim application, the claimant has obtained and paid for all <br /> currently required permits. <br />
