The purpose of this
correspondence is as follows:
First, to serve as notification that continued lack of response and
non-compliance could result in the pursuit of civil and criminal
penalties under Health and Safety Code Sections; 25280 et seq. ,
25500 et seq. , and 25100 et seq. by San Joaquin County's District
Attorneys office. In addition to this, your ability to qualify for
reimbursement of clean-up costs under the State' s Underground
Storage Tank Clean-up Fund will be jeopardized by non-compliance.
Second, PHS/EHD staff conducted a site visit/inspection of the
existing conditions at this site and reported the following:
1) All four monitoring wells were found to be "unsealed" with
water tight caps as required by both city (No. 348) and county
(No. 1862) well ordinances. PHS/EHD further recommends that
the well heads be locked to prevent the potential for
tampering or vandalism.
2) Repair to the stove pipes of Monitoring Well number one (MW-1)
and MW-2 should be completed as soon as possible.
3) Odors observed while inspecting MW-4 strongly suggest that
,(\ groundwater has been impacted by petroleum products in at
J least this particular well. Sample collection and analysis
needs to be completed on all wells on-site as soon as
possible. The minimum verification analyses and testing
methods can be found in Table #2 of the Tri-Regional
Guidelines under Waste and Used Oil or Unknowns.
Each of the problems discovered during the site inspection were
discussed with Dave Alami, the store manager.
A Division of San Joaquin Counry Health rare Services
