The purpose of this <br /> correspondence is as follows: <br /> First, to serve as notification that continued lack of response and <br /> non-compliance could result in the pursuit of civil and criminal <br /> penalties under Health and Safety Code Sections; 25280 et seq. , <br /> 25500 et seq. , and 25100 et seq. by San Joaquin County's District <br /> Attorneys office. In addition to this, your ability to qualify for <br /> reimbursement of clean-up costs under the State's Underground <br /> Storage Tank Clean-up Fund will be jeopardized by non-compliance. <br /> Second, PHS/EHD staff conducted a site visit/inspection of the <br /> existing conditions at this site and reported the following: <br /> 1) All four monitoring wells were found to be "unsealed" with <br /> water tight caps as required by both city (No. 348) and county <br /> (No. 1862) well ordinances. PHS/EHD further recommends that <br /> the well heads be locked to prevent the potential for <br /> tampering or vandalism. <br /> 2) Repair to the stove pipes of Monitoring Well number one (MW-1) <br /> and MW-2 should be completed as soon as possible. <br /> 3) Odors observed while inspecting MW-4 strongly suggest that <br /> groundwater has been impacted by petroleum products in at <br /> least this particular well. Sample collection and analysis <br /> needs to be completed on all wells on-site as soon as <br /> possible. The minimum verification analyses and testing <br /> methods can be found in Table #2 of the Tri-Regional <br /> Guidelines under Waste and Used Oil or Unknowns. <br /> Each of the problems discovered during the site inspection were <br /> discussed with Dave Alami, the store manager. <br /> r . t <br /> A Division of San Joaquin County Health dare Services `� <br />
