Pursuant to the <br /> Environmental Agreement which was a part of that transaction, and which has been provided to your <br /> office, Tosco agreed to undertake all necessary corrective action at the stations it acquired. Tosco <br /> has acknowledged in writing to your agency that it is responsible for completing any necessary <br /> corrective action at the above referenced site. Tosco clearly falls within the definition of <br /> "responsible party" contained in the state's corrective action regulations. 23 C.A.C. Section 2720. <br /> Nonetheless, your agency continues to treat Unocal as the primary responsible party for this site. In <br /> light of the foregoing facts, Unocal regards the agency's position on this matter as arbitrary and <br /> capricious and abuse of its discretion. Unocal once again requests that you address all matters <br /> concerning this station to Tosco. Unocal would appreciate being copied on communications with <br /> respect to this station. <br /> By correspondence of even date, a copy of which is attached, I have requested that Tosco <br /> make an appropriate response to your letter and continue to comply with all requirements at this <br /> property. <br /> 9ter <br /> ours, <br /> iec <br />
