On behalf of UNOCAL, you plan to <br /> file a petition requesting that the State Water Resources Control Board (SWRCB) set aside <br /> our directive to UNOCAL to undertake corrective action since TOSCO has acquired the <br /> service station and is to perform any corrective action. <br /> PHS/EHD has explained to UNOCAL previously that according to the definition of <br /> responsible party in the California Underground Storage Tank (UST) Regulations and our <br /> Local Oversight Program contract UNOCAL is a responsible party for this site and our <br /> directives are to the responsible parties. TOSCO has not been named as a responsible <br /> parry because they did not own or operate the USTs before discontinuation of use and they <br /> do not own the property.
