PHS/EHD in correspondence dated September 26, 1997,directed Tosco on behalf of Unocal to submit an addendum by October 15, 1997 which included additional monitoring wells and soil borings to define the groundwater plume and to investigate the effectiveness of the remediation system to depths below ground surface(bgs)at which significant soil contamination was evidenced prior to the initiation of vapor extraction. PHS/EHD also requested clarification regarding the relationship of Tosco to Unocal since PHS/EHD was concerned that adequate responsible parry notification had been made. PHS/EHD represented by Mary Meays and Margaret Lagorio met with you and two representatives from Pacific Environmental,R.Lee Dooley and Bob Wenzlau on October 10, 1997 at your request to discuss a number issues which were raised in the correspondence dated September 26, 1997. PHS/EHD believed that information was presented in sufficient detail so that compliance with the regulatory directives could be achieved. To date,no work plan addendum has been submitted to comply with the August 13, 1997 PHS/EHD directive. Please be aware that Unocal is out of compliance with regulatory requirements issued pursuant to the California Health and Safety Code and Underground Storage Tank Regulations. An office hearing has been scheduled for Novemberl0, 1997 at 9:30 AM at the office of PHS/EHD to discuss Unocal's compliance status. Please note that PHS/EHD conducted a site inspection of a groundwater monitoring event on October 15, 1997,at which time, PHS/EHD discovered that monitoring wells MW I and MW8,in addition to MW l I could not be located. You should also be aware that PHS/EHD directed Unocal to analyze all groundwater monitoring wells for oxygenates utilizing EPA Method 8260. PHS/EHD has not granted a reduction in the number of wells which undergo this analysis. PHS/EHD was surprised that the sampling firm,MPDS, evidently was unaware of this directive. PHS/EHD understands from the October 10, 1997 meeting,that Tosco is performing some aspects of compliance with the corrective action sections of the Health and Safety Code and Underground Storage Tank Regulations as part of a purchase agreement with Unocal. Since Tosco has not purchased the property,Tosco will not be identified as a responsible party in addition to Unocal and Dayton Hudson Corporation,unless a release from the currently operating tanks is evidenced.
