On June 10, 1992, Plaintiffs filed the Complaint in the above-entitled action <br /> 3 for, inter alia, recovery of damages for public nuisance, private nuisance, trespass, <br /> 4 negligence, strict liability and other claims against SP and Texaco. <br /> 5 2. Thereafter, Plaintiffs filed an amendment naming Chevron as Doe <br /> 6 Defendant 1. <br /> 7 3. Defendants and each of them have denied liability and presently deny <br /> s liability in this action. <br /> s 4. The parties hereto agree that settlement and entry of this Judgment is <br /> 10 made in good faith to avoid expensive and protracted litigation and-to settle and resolve <br /> ii all claims between the parties which have been raised by Plaintiffs' Complaint and <br /> 12 Defendants' response to the pleadings. <br /> 13 5. The parties desire to achieve the timely implementation of an adequate <br /> 14 and cost-effective remedy to effect the cleanup of the property which is the subject of <br /> 1s this action that will effectively protect the public health, welfare and the environment. <br /> 16 6. All parties to this judgment and decree consent to the entry hereof as an <br /> 17 Order, Judgment and Decree of this Court. <br /> 18 THEREFORE, it is hereby ordered, adjudged and decreed that: <br /> 19 1. JURISDICTION. This Court has jurisdiction over the parties and the <br /> 20 subject matter of this action. <br /> 21 2. PARTIES BOUND. This Consent Judgment shall apply to and be binding <br /> 22 upon each of the parties, its agents, employees, successors in interest and assigns.
