t S t Subject Property. 2 0) As used herein, "Remediation" shall mean the future investigation, 3 monitoring and cleanup of the Contamination on the Subject Property, in accordance 4 with this Judgment, including paying the costs thereof, associated with (1) Preparation 5 and implementation of the Plan developed pursuant to this Judgment; (2) Compliance 6 with any additional requirements as may be imposed by the City of Tracy for issuance of 7 building permits; (3) Compliance with duly promulgated orders of any governmental s agency with jurisdiction over the Subject Property, (4) Removal of remediation facilities 9 and equipment, remediation derived waste, and proper abandonment of wells, upon lo completion of Remediation; and (5) any other actions required to comply with this 11 Judgment 12 (k) As used herein, "South Site" shall mean the portion of the Subject 13 Property portrayed on the attached Exhibit B and legally described in the attached 14 Exlubit D. 15 (1) As used herein, "SP" shall mean Southern Pacific Transportation 16 Company. 17 (m) As used herein, "the SP Right of Way" shall mean the SP Right of 18 Way located next to the Subject Property. 9 (n) As used herein, "Subject Property" shall mean the undeveloped land 20 located on either side of Interstate 205 along West Byron Road in Tracy, California 21 owned by Plaintiffs which is the subject of the Action, and which is legally described in 22 the attached Exhibits C and D. 23 (o) As used herein, 'Texaco" shall mean Texaco Trading and 24 Transportation Company, Inc. 25 4.
