PUBLIC HEALTH SERVICES
SAN JOAQUIN COUNTY
b:
JOGI KHANNA M.D.,M.P.H.
Health Officer P
P.O.Box 2009 • (1601 East Hazelton Avenue) • Stockton, California 95201
(209)468-3400
May 11, 1992 { r,
Toxic Technology, Inc.
3197-C Airport Loop Dr.
Costa Mesa, CA 92626
Attn: Adam Zipp
Re: Dividend Development Project
13170 W. Grant Line Rd, Tracy
In May of 1991, a "Site Mitigation Acknowledgement/Request for Services Form" was
submitted by Toxic Technology, along with permit applications and a workplan for
subsurface investigation activities, for the above referenced project. A copy
of the form is enclosed which identifies:
Dividend Development/Tracy Partners
2300 Danville Blvd.
Walnut Creek, CA 94595
as the party responsible for payment of charges for review and inspection
activities performed by San Joaquin County Public Health Services Environmental
Health Division (PHS/EHD) staff on this site. However, the form was signed by
Jeffrey A. Smeak, field operations manager for Toxic Technology.
The original PHS/EHD charges for this project were billed in July 1991. Payment
was not received until September 27, 1991. Therefore, 10% percent penalties were
assessed on the unpaid balance on August 15th and September 15th. The penalty
amount of $208.13 has not been paid and the account is ready to be turned over
to the collector's office.
We have now been informed by Mr. James Medall of Dividend Development that they
did not authorize Toxic Technology to identify his company as the responsible
party for these charges and that he has been forwarding all the invoices to your
office.
Due to the fact we do not have documentation that Toxic Technology was authorized
to sign the request for services form for Dividend Development, we will now
identify your company as the responsible party for billing on this project.
Since this bill is long overdue, your prompt attention to this matter is
appreciated. In addition, no further applications for environmental assessment
or site mitigation activities will be accepted from Toxic Technology, Inc. , until
this matter is resolved.
Jogi Kha-nina M.D. , M.P.H.
Health-"Of 'cer
i
aurie A.
