Grant Line Rd, Tracy <br /> In May of 1991, a "Site Mitigation Acknowledgement/Request for Services Form" was <br /> submitted by Toxic Technology, along with permit applications and a workplan for <br /> subsurface investigation activities, for the above referenced project. A copy <br /> of the form is enclosed which identifies: <br /> Dividend Development/Tracy Partners <br /> 2300 Danville Blvd. <br /> Walnut Creek, CA 94595 <br /> as the party responsible for payment of charges for review and inspection <br /> activities performed by San Joaquin County Public Health Services Environmental <br /> Health Division (PHS/EHD) staff on this site. However, the form was signed by <br /> Jeffrey A. Smeak, field operations manager for Toxic Technology. <br /> The original PHS/EHD charges for this project were billed in July 1991. Payment <br /> was not received until September 27, 1991. Therefore, 10% percent penalties were <br /> assessed on the unpaid balance on August 15th and September 15th. The penalty <br /> amount of $208.13 has not been paid and the account is ready to be turned over <br /> to the collector's office. <br /> We have now been informed by Mr. James Medall of Dividend Development that they <br /> did not authorize Toxic Technology to identify his company as the responsible <br /> party for these charges and that he has been forwarding all the invoices to your <br /> office. <br /> Due to the fact we do not have documentation that Toxic Technology was authorized <br /> to sign the request for services form for Dividend Development, we will now <br /> identify your company as the responsible party for billing on this project. <br /> Since this bill is long overdue, your prompt attention to this matter is <br /> appreciated.
