<br /> 1 could likely be completed within 12 months of the commencement of implementation.
<br /> 2 9. RIGHT TO COMMENT. Notwithstanding paragraph 4(b) above, Plaintiffs
<br /> 3 shall have the right to comment regarding the Plan and the Remediation to all involved
<br /> 4 governmental and regulatory entities asserting jurisdiction over the Subject Property.
<br /> 5 Plaintiffs shall consult with Chevron and Texaco prior to making any comment to any
<br /> s regulatory or governmental agency regarding the Plan, but such consultation obligation
<br /> 7 shall in no way restrict or limit comment Plaintiffs may choose to make. Nothing in this
<br /> 8 paragraph or in the Judgment shall limit Plaintiffs' right to communicate with any
<br /> s governmental or regulatory entity regarding any other aspect of the Subject Property.
<br /> 1 o Plaintiffs shall also have the right, upon reasonable notice, to observe the Remediation
<br /> 11 activities conducted by Texaco and Chevron on the Subject Property.
<br /> 12 10. MUTUAL RELEASE AND COVENANT NOT TO SUE.
<br /> 13 (a) Subject only to subparagraph (d) below, and except as to the
<br /> 14 obligations created by this Judgment, each party to this Judgment, each for itself, its
<br /> 15 employees, partners,Istockholders, directors, officers, trustees, participants, beneficiaries,
<br /> 16 successors, assigns, agents and attorneys, hereby does absolutely discharge and release
<br /> 17 each other, and the others' employees, partners, stockholders, directors, officers, trustees,
<br /> 18 participants, beneficiaries, successors, assigns, agents and attorneys, from any and all
<br /> 19 liabilities, causes of action, claims, which do or may exist, whether known or unknown,
<br /> 20 suspected or unsuspected, relating to or arising out of the Contamination.
<br /> 21 (b) Subject only to subparagraph (d) below, and except as to the
<br /> 22 obligations created by this Judgment, all parties to this Judgment, and each of them,
<br /> 23 covenant and agree that neither they nor their employees, partners, stockholders,
<br /> 24 directors, officers, trustees, participants, beneficiaries, successors, assigns, agents and
<br /> 2s attorneys, will hereafter commence, maintain or prosecute any action at law or otherwise,
<br /> 26 or assert any claim or charge against each other, its employees, partners,'stockholders,
<br /> 27 directors, officers, trustees, participants, beneficiaries, successors, assigns, agents and
<br /> 28 attorneys, for damages or loss of any kind or amount relating to or arising out of the
