Weber Avenue <br /> Stockton, California 95202 <br /> RE: Proposed Michaels store <br /> Tracy Marketplace, Tracy,California <br /> Dear Mike: <br /> As a follow-up to our telephone conversation yesterday,we are in the process of <br /> purchasing the above referenced property from Dividend Liquidation Trusts. Before we <br /> can purchase the property, we need to tie up the paperwork regarding the environmental <br /> status of the property with the applicable governing agency. It is my understanding that <br /> SJCEHD is the governing agency for environmental issues relating to this property. <br /> As we discussed, there is no file on this property (either open or closed) with <br /> SJCEHD or any other agency relating to any environmental contamination or <br /> remediation. We are not,therefore, looking for a closure letter from you. <br /> There is a monitoring well located on our property which we would like to <br /> abandon in connection with our construction of the Michaels store,however, before we <br /> can receive a permit to abandon the well, SJCEHD must approve of the current <br /> environmental state of the property. The monitoring well was installed in 1991 in <br /> connection with the removal of the underground storage tank used on the dairy farm <br /> previously located on the property. There was contamination found during the removal <br /> of the UST(the tank was exempt and did not require permitting). The contamination was <br /> removed in accordance with an approved workplan and the monitoring well was installed <br /> to monitor any groundwater contamination. The Sart Joaquin County Department of <br /> Health assisted in the determination of the final location of the monitoring well (see page <br /> two "Well Location" of the Toxic Technology, Inc. report dated May 13, 1991). To date, <br /> three independent tests(in 1991, 1996 and 2000) of the groundwater have indicated no <br /> traces of any contamination. <br /> We believe that the property is clean and that there is no further need for a <br /> monitoring well. We would like for SJCEHD to provide us with a letter which states that <br /> SJCEHD does not require any further action to be taken on the property in connection <br /> with the prior contamination from the LTST. We would also like to obtain a permit for <br /> removal of the monitoring well. <br /> As I explained to you, our engineer, Cathy Reed from Krazan&Associates, has <br /> submitted a request to you for"No Further Action" dated May 16, 2000.
