intersects with Mascot Boulevard (AKA - Mustang Way) as shown on San Joaquin <br /> Subdivision Map recorded as Tract No . 3649 as depicted on Sheet 5 of 27 (AKA 41 - <br /> 98D) , and as specifically described and depicted on: sheet 18 of 27 (AKA 41 -98Q), <br /> sheet 23 of 27 (AKA 41 -98V) , sheet 24 of 27 (AKA 41 -98W) , and sheet 25 of 27 (AKA <br /> 41 -98X) , with the roadway located west of adjacent Parcels O , N , M , and C as shown <br /> on sheet 5 of 27 (AKA 41 -98D) . (Mustang Way as depicted on San Joaquin County <br /> APN Map 262-02 is the same street labeled Mascot Boulevard on Tract No . 3649 sheet <br /> 3 of 27 (AKA 41 -9813) and Sheet 5 of 27 (AKA 41 -98D) .) See Exhibit "C" for Tract 3649 <br /> maps. <br /> 1 .2 . The Site has been investigated and remediated under the Department's <br /> oversight. The Department remediated the Site under the authority granted it pursuant <br /> to section 25358 .3 of Chapter 6 . 8 of Division 20 of the Health and Safety Code (H&SC) . <br /> The Site was remediated in accordance with a Removal Action Workplan (RAW) <br /> pursuant to Chapter 6.8 of Division 20 of the H&SC . Because hazardous substances as <br /> defined in H&SC section 25316 , which include the organochlorine pesticide dieldrin <br /> remain in the Property's surface soils at concentrations ranging from non-detect to <br /> 0 . 340 milligrams per kilograms (mg/kg) , a deed of restriction Is needed on a portion of <br /> the Site. The RAW provides that a deed restriction be required on a portion of the Great <br /> Valley Parkway Roadway, referred to as the Property, as part of the Site remediation . <br /> The RAW documents surface soil excavation of approximately 40 .6 acres to a <br /> depth of 0.5 feet below ground surface (bgs) . The total in-place volume of soil removed <br /> is approximately 70,000 in-place cubic yards . Excavated soil was encapsulated <br /> beneath a portion of the Great Valley Parkway along the western boundary of the Site in <br /> areas without planned subsurface utilities. The area with the encapsulated soil, defined <br /> above as the Property, is subject to this Covenant. <br /> Following implementation of the RAW, Shea Home's submitted the confirmation <br /> sampling data from the excavation work which demonstrates that the remedial action <br /> goal has been achieved on the remainder of the Site . <br /> 1 . 3 . Basis for Environmental Restrictions . As a result of the presence of <br /> hazardous substances which are also hazardous materials as defined in Health and <br /> Safety Code section 25260 , at the Property, the Department has concluded that it is <br /> Page 3 <br />
