"KST Claims'), Owner shall promptly notify Munco of such KST Claims in writing, and upon receipt of such notice Munco shall defend and indemnify Owner from and against such KST Claims, including reasonable attorney fees and other necessary and appropriate expenses incurred by Owner relating to such KST Claims. in addition, to the extent required by the Water Board or any other federal, state or local regulatory entity, Munco assumes the obligation for responding to, investigating and remediating nitrate contamination originating from the Site and impacting Owners Property, and agrees to bear all actual costs and expenses associated with these assumed obligations. In consideration of this undertaking, Owner agrees (1) to consult with Munco and develop consensus in good faith regarding attorneys and other consultants or experts to be secured for defending or otherwise handling the KST Claims; and (2) to cooperate otherwise with Munco in dealing with the Water Board or other applicable entities or parties concerning these obligations. 6. Owner's Tenants Owner shall notify Munco in writing if a tenant or tenants on Owners Property change, furnishing correct mailing and telephone information to Munco to enable proper notice to such tenants of Munco's operations hereunder, 6.3. Reports All Site investigation reports, including but not limited to all quarterly groundwater monitoring reports, geological logs, sampling and analysis plans, reports and all other supporting data, shall be submitted to Owner as they are generated by Munco, In addition, a copy of all correspondence containing comments and/or other information pertinent to the Site, as generated by the Water Board or other parties, shall be provided to the Port as they are received by Munco. -W5.
