Edison Street <br /> Stockton, CA 95203 ,• may l <br /> 00) <br /> Dear Mr. Fowler: <br /> v <br /> RE: Site Approval Application No. SA-90-29 (APN 023-100-19) <br /> This letter is meant to serve as confirmation of our telephone <br /> conversation yesterday, in which I stated that the existing ponds <br /> may remain in place, pending a recommendation by the Planning <br /> Commission on the Draft General Plan' s Development Regulations. <br /> That determination is based upon the fact that your ponds are now <br /> located at least ten-feet away from both State Route 12 and Johnson <br /> Road, which is staff ' s recommendation to the Commission for the <br /> minimum setback from property lines to the toe of the slope of the <br /> pond. Depending upon the Planning Commission' s recommendation <br /> later this summer, you will either be required to remove/relocate <br /> the ponds or be allowed to start meeting the Conditions of <br /> Approval. In the former case, you will be given a new deadline for <br /> removing/relocating the ponds; in the latter case, all Conditions <br /> of Approval must be met prior to the initiation of the use of the <br /> fish ponds. <br /> Until such time as the Planning Commission makes a recommendation <br /> on this matter, no further excavation, filling with water, or other <br /> such work on the ponds will be permitted.
