Edison Street Stockton, CA 95203 ,• may l 00) Dear Mr. Fowler: v RE: Site Approval Application No. SA-90-29 (APN 023-100-19) This letter is meant to serve as confirmation of our telephone conversation yesterday, in which I stated that the existing ponds may remain in place, pending a recommendation by the Planning Commission on the Draft General Plan' s Development Regulations. That determination is based upon the fact that your ponds are now located at least ten-feet away from both State Route 12 and Johnson Road, which is staff ' s recommendation to the Commission for the minimum setback from property lines to the toe of the slope of the pond. Depending upon the Planning Commission' s recommendation later this summer, you will either be required to remove/relocate the ponds or be allowed to start meeting the Conditions of Approval. In the former case, you will be given a new deadline for removing/relocating the ponds; in the latter case, all Conditions of Approval must be met prior to the initiation of the use of the fish ponds. Until such time as the Planning Commission makes a recommendation on this matter, no further excavation, filling with water, or other such work on the ponds will be permitted.
