HAZELTON AVENUE, STOCKTON, SAN <br /> JOAQUIN COUNTY (RB CASE# 390489) <br /> On behalf of the Central Valley Regional Water Quality Control Board (Central Valley Water <br /> Board), I would like to inform you that as of 1 June 2016, 1 am the assigned caseworker for your <br /> site at 1810 Hazelton Avenue in Stockton. My contact information is included at the end of this <br /> letter. <br /> I have reviewed the Notice of Intent (NOI) submitted 20 April 2016 by Condor Earth <br /> Technologies Inc. (Condor) as part of the plan to implement ozone injection to address cleanup <br /> of the fuel products released from the former underground storage tanks at this Site. The NOI <br /> was incomplete and could not be processed as submitted. An NOI Addendum and a Work Plan <br /> to delineate the extent of impacts to soil and groundwater at the Site need to be prepared and <br /> submitted for our review. <br /> My comments on the NOI and the investigation of the unauthorized release of petroleum from <br /> the Public Works yard are as follows: <br /> 1. The submitted NOI is believed to have been intended as an application for coverage under <br /> Order No. R5-2015-00012, Waste Discharge Requirements General Order for In-Situ <br /> Groundwater Remediation and Discharge of Treated Groundwater to Land(General Order). <br /> However, the application submitted consisted only of the Notice of Intent form. As detailed <br /> in the General Order, an application is required to include a Monitoring and Reporting Plan <br /> (MRP), as well as a Contingency Plan and Additional Information as outlined in Attachment <br /> 1, of the General Order. A detail of requirements for the MRP, which also serves as a <br /> sample MRP template, can be found as Attachment C of the General Order. A fee check in <br /> the amount of$4699.00 is also required for the first year of applicable remedial activities. <br /> The Notice of Exemption submitted 21 April 2016 is not applicable to this application <br /> process. By 30 October 2016, please submit an NOI Addendum, to serve as an application <br /> to operate under the General Order, which includes an MRP, Contingency Plan, <br /> Supplemental Information outlined in Attachment 1 of the General Order, and a fee check in <br /> the amount of $4699.00.
