The contamination was <br /> found through analysis of soil and groundwater samples collected on December 20, 2004. <br /> Enclosed is a copy of a form completed by Beneto Tank Lines agent, Roger Liston, with a <br /> statement that Ramos Oil took over operation of the facility on November 16, 2004. Also <br /> enclosed is a Certification of Financial Responsibility form signed by William Ramos as the owner <br /> or operator of the underground storage tank dated December 8, 2004. Additionally, enclosed is a <br /> copy of the California Code of Regulations Section 2720 that defines a responsible party as any <br /> person who owns or operates an underground storage tank used for the storage of any <br /> hazardous substance and any person who had or has control of a underground storage tank at <br /> the time of or following an unauthorized release of a hazardous substance. Since Ramos Oil <br /> Company was the operator of the underground storage tank when the contamination was found <br /> and it is not known when the release occurred you have been named as a responsible party. <br /> The EHD directed that a work plan for further investigation of the site be submitted by July 15, <br /> 2005. To date a work plan has not been submitted to EHD.
