'Vwool � <br /> 1 certain samples of the agricultural supply well located several ti <br /> 2 hundred feet away from the UST location. <br /> 3 Based on the fact that (1) toluene was not detected in the <br /> 4 soil beneath the tank beyond a depth of 15 feet, (2) toluene was <br /> 5 not detected in the groundwater grab sample taken at a depth of <br /> 6 75 feet in the immediate vicinity of the tank, (3) the level of <br /> 7 toluene in the MW-1 sample is so low as to indicate it is most <br /> g likely associated with lab contamination, and (4) the level of <br /> 9 toluene found at the site does not exceed naturally occurring <br /> 10 background levels, it is the opinion of both consultants that the <br /> 11 UST did not result in any groundwater contamination whatsoever; <br /> 12 Johnson (Levine Fricke) Decl. at p. 5; Summerlin (SG&D) Decl. at <br /> 13 P. 3. <br /> 14 Moreover, even if both consultants are wrong (and the <br /> 1511 toluene is associated with the UST) , toluene is not considered a <br /> 16 particularly toxic chemical' and, at the extremely low levels <br /> 17 detected could never justify further expensive groundwater <br /> 18 investigation at the Site. As an alternative basis <br /> 21 for issuing the order, the Health Department relies on the <br /> 22 detection of benzene at .0001 ppm to .0004 ppm in certain <br /> 23 groundwater samples extracted from the agricultural supply wells. <br /> 24 located at a distance of 500 to 2,000 feet from the UST location. <br /> + 25 However, no evidence whatsoever exists indicating that the <br /> 26. <br /> 27 Toluene is not a known carcinogen and the known health <br /> effects are limited to narcosis and moderate irritation of eyes,. <br /> 28 nose, throat and skin.
