PUBLIC hEALTH SERV ICES PpU N
SAN JOAQUIN COUNTY 2. o
ENVIRONMENTAL HEALTH DIVISION " r
Ernest M. Fujimoto, M. D., M.P.H., Acting Health Officer
304 E. Weber Ave., Third Floor • P. O. Box 388 • Stockton, `t C4`icpR P
209/468-3420 i f
FRANK DISHMAN MAILED FEB 1 61996
SAN JOAQUIN COUNTY PUBLIC WORKS
P O BOX 1810
STOCKTON CA 95201
RE: PERMIT TO OPERATE - 1810 E HAZELTON, STOCKTON
The review of the file for the above noted site by San Joaquin County Public Health Services,
Environmental Health Division (PHS-EHD) has revealed that operating permits for this facility had not
been issued by this office for some years.
Section 2712(d) of the 1985 Underground Tank regulations (California Administrative Code, Title 23,
Chapter 3, Subchapter 16) stated that "the local agency shall not issue a permit to operate an
underground storage tank" until the local agency had inspected the facility and determined that the
tank(s) complied with the regulations. Our interpretation of the statute implied that underground
storage tank sites lacking a local agency inspection or sites with soil or groundwater contamination
could not be issued operating permits until the following was achieved: 1) a site inspection evaluation;
2) verification of appropriate monitoring method; 3) adequate and appropriate inventory reconciliation;
and/or 4) complete investigation and cleanup of the contaminated site. Due to this interpretation of the
law, this site, as well as many others, were not issued a permit.
A total of eight underground storage tanks were used at this site over the years, with three currently
active at this time. The file documents that all fees had been paid, that all operating requirements had
been satisfied, and that the former tanks at the site were removed under permit and guidance of PHS-
EHD. Therefore, it is our determination that this facility was operating in substantial compliance with
the regulations and should be considered for State funding.
If you have any questions or wish to discuss this letter in more detail, please contact Linda Turkatte,
Senior REHS, at (209) 468-3441.
Donna Heran, REHS, Director
Environmental Health Division
Linda Turkatte, Senior REHS Diane M.
