Box 388 • Stockton, `t C4`icpR P <br /> 209/468-3420 i f <br /> FRANK DISHMAN MAILED FEB 1 61996 <br /> SAN JOAQUIN COUNTY PUBLIC WORKS <br /> P O BOX 1810 <br /> STOCKTON CA 95201 <br /> RE: PERMIT TO OPERATE - 1810 E HAZELTON, STOCKTON <br /> The review of the file for the above noted site by San Joaquin County Public Health Services, <br /> Environmental Health Division (PHS-EHD) has revealed that operating permits for this facility had not <br /> been issued by this office for some years. <br /> Section 2712(d) of the 1985 Underground Tank regulations (California Administrative Code, Title 23, <br /> Chapter 3, Subchapter 16) stated that "the local agency shall not issue a permit to operate an <br /> underground storage tank" until the local agency had inspected the facility and determined that the <br /> tank(s) complied with the regulations. Our interpretation of the statute implied that underground <br /> storage tank sites lacking a local agency inspection or sites with soil or groundwater contamination <br /> could not be issued operating permits until the following was achieved: 1) a site inspection evaluation; <br /> 2) verification of appropriate monitoring method; 3) adequate and appropriate inventory reconciliation; <br /> and/or 4) complete investigation and cleanup of the contaminated site. Due to this interpretation of the <br /> law, this site, as well as many others, were not issued a permit. <br /> A total of eight underground storage tanks were used at this site over the years, with three currently <br /> active at this time. The file documents that all fees had been paid, that all operating requirements had <br /> been satisfied, and that the former tanks at the site were removed under permit and guidance of PHS- <br /> EHD.
