CALIFORNIA 9.5376 <br /> August 17 , 1987 <br /> San Joaquin County Planning Division SAN JOAQUIN COUN-ri <br /> 1810 East Hazelton PLANNING DEPARTMENT <br /> Stockton, California 95205 <br /> Re : Application No . : MS-87-76 <br /> Applicant : Gladys Ceciliani <br /> Gentlemen: <br /> In response to your referral notice of August 12 , 1987 , <br /> this district has the following comments : <br /> ( 1) The drain ditch which forms the north boundary of the <br /> applicant ' s property is owned by this district. Our title includes <br /> not only the ditch itself but a 30' easement and both sides for <br /> cleaning , maintaining and operating the ditch. The easement <br /> extends 30' from each edge of the ditch bank. From time to time , <br /> the district piles mud dredged from the ditch bottom along the <br /> outer edge of this easement . <br /> We cannot tell from the small scale map supplied whether <br /> the residential home site (Parcel A) intrudes upon this easement , <br /> but we suggest the county see to it that Parcel A is placed far <br /> enough south to avoid any conflict with our right of way . <br /> In this connection, I understand the precise location of <br /> the drain ditch has never been surveyed so that merely tying the <br /> lot boundary to Bethany Road may not be adequate to insure the <br /> north boundary of the lot is at least 30' south of the south edge <br /> of the ditch. Perhaps , the north boundary of Parcel A should <br /> somehow be referenced to the ditch so as to insure allowance for <br /> the 30' easement along its south bank. <br /> (2) District irrigation water is presently delivered to <br /> Parcel B. If it is desired to have such water available for Parcel <br /> A as well, then a suitable easement over Parcel B must be reserved <br /> in favor of Parcel A. <br />
