FACILITY, RIPON, SAN JOAQUIN COUNTY <br /> Central Valley Regional Water Quality Control Board (Central Valley Water Board) staff <br /> received the 13 September 2010 document titled 2010 Revised Water Replacement <br /> Contingency Plan (Plan). The document was prepared by Environmental Cost Management, <br /> Inc., (ECM), on behalf of Nestle USA, Inc. (Nestle) for the former Nestle coffee <br /> decaffeination facility project (Project) located at 230 Industrial Avenue, Ripon, California. <br /> Nestle had submitted an earlier 2010 Plan dated 3 May 2010, and Central Valley Water <br /> Board staff commented on it in a 6 August 2010 review letter. Staff did not approve that <br /> Plan primarily because it proposed to delete the contingency for replacement of water in a <br /> domestic water supply well in the event that a Project chemical of concern concentration <br /> exceeded a California Public Health Goal in any six months of a twelve consecutive month <br /> period. That contingency had been negotiated with Nestle in March 2007, and included in <br /> the approved Plan dated 15 May 2007. During a telephone conversation on 5 August 2010, <br /> you and other Nestle representatives discussed the May 2010 Plan with me. You indicated <br /> that Nestle would revise and resubmit the Plan later in 2010. 1 indicated that the 15 May <br /> 2007 Plan would remain in effect until you submitted an acceptable revised plan. <br /> The September 2010 Plan includes the domestic water well contingency discussed in the <br /> 6 August 2010 review letter, and therefore, is acceptable to the Central Valley Water Board. <br /> The 15 May 2007 Plan has been rescinded and the 13 September 2010 Plan approved. <br /> If you have any questions, please contact me at (916) 464-4675, or by email at <br /> jbrownell@waterbo6rds.ca.gov. <br /> 4"'C-A � . <br /> JAMES R.
