FACILITY, RIPON, SAN JOAQUIN COUNTY <br /> Central Valley Regional Water Quality Control Board (Central Valley Water Board) staff <br /> received the 3 May 2010-draft document titled 2010 Revised Water Replacement <br /> Contingency Plan (2010 Draft Plan). The document was prepared by Environmental Cost <br /> Management, Inc., (ECM), on behalf of Nestie USA, Inc. (Nestle) for the former Nestle coffee <br /> decaffeination facility project (Project) located at 230 Industrial Avenue, Ripon, California. <br /> During a telephone conversation on 5 August 2010, you and other Nestle representatives <br /> discussed the 2010 Draft Plan with me. You indicated that the current 15 May 2007 Revised <br /> Water Replacement Contingency Plan (2007 Plan) was too complicated and that the <br /> 2010 Draft Plan would solve implementation problems. Apparently, in practice ECM has <br /> found it difficult to use, especially in conjunction with the current Monitoring and Reporting <br /> Program R5-2010-0810. 1 indicated that Central Valley Water Board staff cannot approve the <br /> 2010 Draft Plan primarily because it proposes to drop the contingency for replacement of <br /> water in a domestic water supply well in the event that a Project contaminant of concern <br /> concentration exceeds a PHG in any six months of a twelve consecutive month period. That <br /> contingency was negotiated with Nestle in March 2007. You indicated that Nestle will <br /> resubmit a revised 2010 Draft Plan.
