OCT 5 2006
Attention: Mr. Mike Desso ENVIRONMENT HEALTH
800 North Brand Boulevard PERMITS ACES
Glendale, California 91203
DRAFT WATER REPLACEMENT CONTINGENCY PLAN, FORMER NESTLE USA, INC.
FACILITY, RIPON, SAN JOAQUIN COUNTY
California Regional Water Quality Control Board, Central Valley Region (Regional Water
Board) staff has reviewed the Draft Water Replacement Contingency Plan, Former Nestle
USA Inc., Facility, dated September 2006 (Draft Plan) and received 7 September 2006. The
Draft Plan was prepared by Geomatrix Consultants, Inc. (Geomatrix), on behalf of Nestle
USA, Inc. (Nestle) for the former facility located at 230 Industrial Avenue, Ripon, California
(former facility). The comments below are based on Regional Water Board staff review of
the Draft Plan. Nestle should submit a final Water Contingency Plan incorporating the
Regional Water Board's comments.
Nestle prepared the Draft Plan to comply with Required Action No. 2 of Cleanup and
Abatement Order No. R5-2006-0720, issued by the Regional Water Board on 24 July 2006.
The required action directs Nestle to provide in-kind replacement of water supplies
threatened or impacted by pollution originating from their former facility.
Definitions Presented in the Draft Plan
The Draft Plan defines the following categories of threatened and impacted wells:
• Potentially threatened domestic or municipal supply well,
• Threatened domestic or municipal supply well,
• Potentially impacted domestic or municipal supply well,
• Impacted domestic or municipal supply well,
• Potentially threatened agricultural well, and
Potentially impacted agricultural well.
The Draft Plan states, "It is not currently possible to determine if an agricultural well has
been impacted". Apparently, this statement was based on the fact that the Regional Water
Board's document entitled A Compilation of Water Quality Goals, August 2003, does not list
California Environmental Protection Agency
Qd Recycled Paper
