Nestle USA, Inc.—Ripon, CA January 28, 2011
2011 Revised Feasibility Study
risk-, or technology-based numerical values that establish an acceptable amount
or concentration of a chemical that may be found in or discharged to the ambient
environment. Action-specific requirements restrict treatment and disposal
activities related to the management of hazardous substances. Location-specific
requirements restrict activities or chemical concentrations due solely to location
of a site within a sensitive area such as a flood plain, wetlands, or a historic
district.
The July 24, 2006 CAO assigns the following policies and regulations:
• California Water Code, sections 13304(a), 13305(f), 13267(b)(1), and
13304(c)(1);
• State Water Resources Control Board Resolution No. 92-49, Policies and
Procedures for Investigation and Cleanup and Abatement of Discharges
Under Water Code Section 13304;
• State Water Resources Control Board Resolution No. 68-16, Statement of
Policy With Respect to Maintaining High Quality of Waters in California;
• Title 23, California Code of Regulations (CCR) Section 2550.4; and
• RWQCB's Water Quality Control Plan for the Sacramento River and San
Joaquin River Basins, 4th Edition (hereafter Basin Plan).
Additional regulations potentially governing the Study Area include the following:
• USEPA Preliminary Remediation Goals (PRGs),
• Resource Conservation and Recovery Act (RCRA; 40 CFR 261), and
• Title 22 CCR, Article 11 for non-RCRA, state-regulated hazardous wastes.
The following subsection discussions incorporate these policies and regulations.
7.1 Chemical-Specific Requirements
Potential ARARs, as described in the following section, apply to COCs in both
soil and groundwater.
18
