Regional Board Action for Which This Petition for Review of Action is Sought: <br /> The Regional Board's action for which this Petition is filed is the Technical Reporting <br /> Order No. R5-2011-0800, dated March 3, 2011, a copy of which is attached as EXHIBIT 1, and <br /> incorporated herein by reference. <br /> 3. The Date the Regional Board Acted: <br /> The date the Regional Board's action subject to review is March 3, 2011. <br /> REQUEST FOR STAY AND HEARING <br /> Petitioner's request for a stay and evidentiary hearing pending review of the merits of the <br /> Petition in order that Petitioner and/or counsel, and other designated parties, can participate in a <br /> hearing and given the opportunity to present evidence and testimony based on the following: <br /> A. There will be substantial harm to the Petitioner if a stay is not granted. As <br /> further elaborated below, requiring Petitioner to proceed with the investigation and technical <br /> report requested in the Order will subject Petitioner to ongoing and unreasonable expenses, when <br /> the Board has not provided sufficient evidence as to how Petitioner may be related to the <br /> groundwater contamination observed. <br /> B. There will be no substantial harm to other interested persons and/or to the <br /> public interest, if a stay is granted because Chevron is presently undergoing an investigation and <br /> remediation of similar contamination adjacent to and surrounding this property and it appears the <br /> situation is stabilized. <br /> C. There are substantial questions to fact or law regarding the disputed action. <br /> Petitioner will show through this petition, specifically in Issues 1 through 5, that there are several <br /> factual and evidentiary inaccuracies in the Board's Order with respect to the 2008 spill of <br /> approximately 15-20 gallons of diesel, and thel998 spill of approximately 40 gallons of diesel. <br /> Attached hereto, and incorporated herein is a Declaration of Patrick D. Riddle in support <br /> thereof. <br /> D. Petitioner's summary of arguments,testimony and/or evidence to be introduced <br /> at Hearing: <br /> Petition for Review/Request for Hearing <br /> -2- <br />
