Presley-Tanner Hazardous Substance Account Act ( Health and Safety Code Section 25300 et seq .) ; the Hazardous Waste Control Law ( Health and Safety Code Sections 25100 et seq .) and the Clean Water Act (33 U . S . C . Sections 1251 et seq .) and any and all applicable federal , state or local laws , codes, regulations ordinances or other requirements of any kind pertaining to underground storage tanks_ (c) Any reports , repairs or work required by CITY with respect to the Property are the sole responsibility of CITY . CITY agrees that there is no obligation on the part of COUNTY to make any changes, alternations or repairs to the Property or to cure any violations of Law or to comply with the - requirements of any government agency with respect to conditions on , about or under the Property, including satisfying any requirements of the County Health Department, the Regional Water Quality Control Board , the Department of Toxic Substances Control or any other government agency concerning the investigation and remediation of any contamination on , about or under the Property . CITY is solely responsible for obtaining any and all permits necessary for its intended use of the Property. (d) CITY for the CITY and for its successors and assigns , hereby releases COUNTY from, and waives all claims and liability against COUNTY for or attributable to any and all statements or opinions heretofore or thereafter made, or information furnished by the COUNTY to CITY or its agents attorney or representatives . (e) CITY acknowledges and agrees that the provisions of this Section 12 wore a material factor in COUNTY's acceptance of the Purchase Price and COUNTY is unwilling to sell the Property unless COUNTY is expressly released and indemnified as set forth in this Section 12 . (f) COUNTY has disclosed to CITY the results of environmental investigations conducted by or on behalf of COUNTY relating to contamination of the Property ("Existing Contamination" .) For purposes of this agreement, Existing Contamination shall mean that hydrocarbon contamination in soils and groundwater identified to date in technical reports prepared on behalf of the COUNTY by Ramage Environmental with respect to the Property and which originated from the underground storage tanks and fuel dispensing areas identified in said reports. The acquisition price of the Property being acquired in this transaction reflects a negotiated price for the Property in its contaminated condition . CITY assumes all responsibility for, and hereby agrees to release , indemnify , protect, defend and hold COUNTY harmless with respect to all claims, liabilities , losses and damages of any kind arising from or relating to the Existing Contamination , Including the costs of investigation and remediation of contamination on, about or under the Property which may be required by any Page 5 of 9 50 30vd A3dd00 AV17 bLOZL9b60Z 69 : LZ G00Zl90I0L
