Presley-Tanner Hazardous Substance Account Act ( Health and Safety Code <br /> Section 25300 et seq .) ; the Hazardous Waste Control Law ( Health and Safety <br /> Code Sections 25100 et seq .) and the Clean Water Act (33 U . S . C . Sections 1251 <br /> et seq .) and any and all applicable federal , state or local laws , codes, regulations <br /> ordinances or other requirements of any kind pertaining to underground storage <br /> tanks_ <br /> (c) Any reports , repairs or work required by CITY with respect to the Property <br /> are the sole responsibility of CITY . CITY agrees that there is no obligation on the <br /> part of COUNTY to make any changes, alternations or repairs to the Property or <br /> to cure any violations of Law or to comply with the - requirements of any <br /> government agency with respect to conditions on , about or under the Property, <br /> including satisfying any requirements of the County Health Department, the <br /> Regional Water Quality Control Board , the Department of Toxic Substances <br /> Control or any other government agency concerning the investigation and <br /> remediation of any contamination on , about or under the Property . CITY is solely <br /> responsible for obtaining any and all permits necessary for its intended use of the <br /> Property. <br /> (d) CITY for the CITY and for its successors and assigns , hereby releases <br /> COUNTY from, and waives all claims and liability against COUNTY for or <br /> attributable to any and all statements or opinions heretofore or thereafter made, <br /> or information furnished by the COUNTY to CITY or its agents attorney or <br /> representatives . <br /> (e) CITY acknowledges and agrees that the provisions of this Section 12 wore <br /> a material factor in COUNTY's acceptance of the Purchase Price and COUNTY <br /> is unwilling to sell the Property unless COUNTY is expressly released and <br /> indemnified as set forth in this Section 12 . <br /> (f) COUNTY has disclosed to CITY the results of environmental <br /> investigations conducted by or on behalf of COUNTY relating to contamination of <br /> the Property ("Existing Contamination" .) For purposes of this agreement, Existing <br /> Contamination shall mean that hydrocarbon contamination in soils and <br /> groundwater identified to date in technical reports prepared on behalf of the <br /> COUNTY by Ramage Environmental with respect to the Property and which <br /> originated from the underground storage tanks and fuel dispensing areas <br /> identified in said reports. The acquisition price of the Property being acquired in <br /> this transaction reflects a negotiated price for the Property in its contaminated <br /> condition . CITY assumes all responsibility for, and hereby agrees to release , <br /> indemnify , protect, defend and hold COUNTY harmless with respect to all claims, <br /> liabilities , losses and damages of any kind arising from or relating to the Existing <br /> Contamination , Including the costs of investigation and remediation of <br /> contamination on, about or under the Property which may be required by any <br /> Page 5 of 9 <br /> 50 30vd A3dd00 AV17 bLOZL9b60Z 69 : LZ G00Zl90I0L <br />
