Box 400 <br /> Tracy, CA 95378 <br /> ADMINISTRATIVE CIVIL LIABILITY COMPLAINT R5-2012-0520 FOR ASSESSMENT OF <br /> MANDATORY MINIMUM PENALTIES, DEPARTMENT OF CORRECTIONS AND <br /> REHABILITATION, DEUEL VOCATIONAL INSTITUTION, SAN JOAQUIN COUNTY <br /> Enclosed is an Administrative Civil Liability Complaint (Complaint), issued pursuant to California <br /> Water Code section 13385, for violations of Waste Discharge Requirements (WDRs) Order R5- <br /> 2008-0164 (NPDES No. CA0078093) by the Department of Corrections and Rehabilitation <br /> (Discharger) at the Deuel Vocational Institution. The Complaint charges the Discharger with <br /> administrative civil liability in the amount of forty-two thousand dollars ($42,000), which <br /> represents the sum of accrued Mandatory Minimum Penalties for effluent limitation violations <br /> (identified in Attachment A to the Complaint) that occurred from 1 March 2011 through <br /> 31 December 2011. <br /> On 3 February 2012, Central Valley Water Board staff issued a draft Record of Violations <br /> (ROV). On 24 February 2012, the Discharger responded that the pH,violation listed in the draft <br /> ROV had previously been dismissed by Board staff. Staff agreed that there was an error and <br /> deleted that violation from the ROV. The Discharger also submitted a letter on 5 March 2012 <br /> requesting that the EC and ammonia violations be withdrawn. Upon review, Board staff have <br /> retained the violations. <br /> Pursuant to CWC section 13323, the Discharger may: <br /> • Pay the proposed administrative civil liability and waive its right to a hearing (Option #1 on <br /> the attached waiver form); <br /> • Ask that the hearing be postponed to facilitate settlement discussions or for other reasons <br /> (Options #2 or#3 on the attached waiver form); or <br /> • Contest the Complaint and/or enter into settlement discussions without signing the <br /> enclosed waiver. <br /> If the Central Valley Water Board does not receive a signed waiver by 9 April 2012, a hearing <br /> will be scheduled for the 718 June 2012 Board meeting in Rancho Cordova.
