There seems to be an advantage when one uses one <br /> property to fold in order to acquire another property with the <br /> existing bankruptcy laws. <br /> Response • <br /> No comment . <br /> Basis of Appeal , Item XI : <br /> Consideration was not adequately given to public utilities and <br /> facilities . There is not sewage system to handle a sub- <br /> division. We request the Commission consider the study done by <br /> that Commission, the Micke Grove Plan, which states the limita- <br /> tions existing in the area. <br /> Response• <br /> Sewage disposal is proposed to be handled by an individual sep- <br /> tic system and domestic well under permit from the Local Health <br /> District . Public facilities are not normally required for Minor <br /> Subdivisions unless located in urbanized areas . <br /> Basis of Appeal , Item XII : <br /> This proposal is inconsistent with application in this area and <br /> is not mandated by law. It is an encroachment on agricultural <br /> land use and has been applied indiscriminately to someone <br /> designated as owner-operator, who, in reality is not a farmer . <br /> Response• <br /> The proposal was processed in the same manner as other proper- <br /> ties under similar circumstances under Section 9-9104(b) of the <br /> Planning Title. Refer to the definition of "owner-operator" <br /> noted under Item II . <br /> Basis of Appeal , Item XIII : <br /> The applicant , Mr. Jagir , supplied no proof from the present <br /> lender relinquishing the requested acreage as security from his <br /> note. <br /> Response: <br /> -15- <br />
