The LUC was recorded on October 7, 2010, and is stamped <br /> with Document# 2010-131794. DTSC requires a LUC to prevent inappropriate land use <br /> activities due to residual hazardous substances contained in the subsurface soils at the <br /> Site. Previous environmental investigations at the Site identified the following <br /> contaminant and range of concentrations in on-site soils: Lead at a range of 3.2 — 310 <br /> milligrams per kilogram of soil. <br /> The LUC can be removed from the property by reducing, or removing, the contaminant <br /> in the soil to unrestricted land use levels. While the LUC is in place for the Site the <br /> DTSC approved Soil Management Plan dated April 21, 2010 (April 2010 Soil <br /> Management Plan, copy enclosed), or another Soil Management Plan approved by <br /> DTSC, is required for compliance with the LUC. <br /> Please note that Section 4.04 of the LUC requires that the Site Owner conduct and <br /> submit an annual inspection of the Site and submit a report to DTSC to verify <br /> compliance with the LUC by January 15th of each year. Also note that Section 3.05 of <br /> the LUC identifies that the Site Owner agrees to pay DTSC's costs in administering the <br /> LUC, should there be any. <br /> ® Printed on Recycled Paper <br />
