You state that you have had many conversations with Tim O'Brien of my staff about this <br /> matter. Mr. O'Brien agrees that he has had numerous conversations with you and the multiple <br /> consultants working for you. He has informed the parties that the former Suprema Cheese facility was <br /> unable to comply with the effluent limitations of WDRs No. 5-00-057 and that groundwater monitoring <br /> has revealed the degradation of the groundwater beneath the waste disposal ponds. Therefore, CSC will <br /> not be able to operate in the same manner as Suprema, and upgrades to the wastewater treatment, <br /> storage, and disposal system will be necessary. He has previously informed you that for these reasons, <br /> the existing Order must be updated and cannot be transferred directly to CSC. <br /> The fact that the permit cannot be transferred has not hindered CSC from beginning operations at the <br /> facility. In October 2003, CSC submitted a Report of Waste Discharge (RWD) and applied for coverage <br /> under Resolution No. R5-2003-0016, the waiver of waste discharge requirements for small food <br /> processors. On 21 November 2003, the Executive Officer granted CSC coverage under the Resolution <br /> on the condition that ail wastewater will flow to a sump from which it will be pumped into a truck and <br /> transported to the City of Manteca wastewater treatment facility. This discharge of waste may continue <br /> until (and if) CSC decides to submit a RWD for a different treatment/disposal system. <br /> For the above reasons, staff have asked the Board to consider rescinding Order No. 5-00-057 at the <br /> 18/19 March 2004 meeting. Please note that the Board cannot allow two differing permits, with <br /> different discharge requirements, to both be valid at the same facility. Therefore, Order No. 5-00-057 <br /> must be rescinded. If you wish to contest the rescission, then you will need to appear at the beginning of <br /> the meeting on 19 March 2004.
