You state that you have had many conversations with Tim O'Brien of my staff about this matter. Mr. O'Brien agrees that he has had numerous conversations with you and the multiple consultants working for you. He has informed the parties that the former Suprema Cheese facility was unable to comply with the effluent limitations of WDRs No. 5-00-057 and that groundwater monitoring has revealed the degradation of the groundwater beneath the waste disposal ponds. Therefore, CSC will not be able to operate in the same manner as Suprema, and upgrades to the wastewater treatment, storage, and disposal system will be necessary. He has previously informed you that for these reasons, the existing Order must be updated and cannot be transferred directly to CSC. The fact that the permit cannot be transferred has not hindered CSC from beginning operations at the facility. In October 2003, CSC submitted a Report of Waste Discharge (RWD) and applied for coverage under Resolution No. R5-2003-0016, the waiver of waste discharge requirements for small food processors. On 21 November 2003, the Executive Officer granted CSC coverage under the Resolution on the condition that ail wastewater will flow to a sump from which it will be pumped into a truck and transported to the City of Manteca wastewater treatment facility. This discharge of waste may continue until (and if) CSC decides to submit a RWD for a different treatment/disposal system. For the above reasons, staff have asked the Board to consider rescinding Order No. 5-00-057 at the 18/19 March 2004 meeting. Please note that the Board cannot allow two differing permits, with different discharge requirements, to both be valid at the same facility. Therefore, Order No. 5-00-057 must be rescinded. If you wish to contest the rescission, then you will need to appear at the beginning of the meeting on 19 March 2004.
