JUN-04-1999 12:25 937726 P.02 <br /> Administrative Order <br /> Regarding property located at 8635-8637-8639 Acapulco Way <br /> The intent of this ruling is to provide consideration of the personal hardships faced by the property <br /> owner, Shafiq Ahmad,while factoring the health and safety issues and the right of area property <br /> owners to protect their investments. <br /> Hearing Officer, Anthony Trent Russo will retain jurisdiction in this matter. The subject of the <br /> appeal is as follows: <br /> Administrative Citations #8512 $500.00 <br /> #8513 $100.00 <br /> #8523 $500.00 <br /> #8524 $250.00 <br /> #8927 $500.00 <br /> #8928 $500.00 <br /> Total $2,350.00 <br /> All violations cited on Administrative Citation#8927 and#8928 are to be corrected within 90 days, <br /> beginning on May 28, 1999(by August 25, 1999)_ If all of the corrections are completed within 45 <br /> days (by July 11, 1999), the entire amount of$2,350.00 will be waived, If all of the corrections <br /> are completed within 60 days(by July 26, 1999), %:of the above referenced fines($1,175.00)will <br /> be waived. If all of the corrections are completed within 80 days(by August 15. 1999) A of the <br /> above referenced fines($587.50)will be waived. Corrections made after August 15, 1999, will <br /> not result in any reduction of the above referenced fines. <br /> If the corrections have not been completed within the 90 day period, civil penalties will be <br /> assessed. If a good faith effort is demonstrated, the civil penalties will consist of$50.00 per day <br /> until the property owner has scheduled an inspection with the Code Enforcement Officer and the <br /> officer verifies compliance. If a lack of good faith effort is demonstrated, civil penalties will consist <br /> of an amount up to$100.00 per day. <br /> Additional orders: <br /> The violation concerning the exit pathway presents a safety issue that may endanger the lives of <br /> the occupants. Therefore, repair or replacement of the exit pathway in the center courtyard and <br /> removal of the tree that has caused the detehoration/raising of the pathway must commence <br /> within 5 days(by June 1, 1999). The cost of the tree removal and pathway repair/replacement is <br /> to be shared equally by the responsible property owners, Shafiq Ahmad, and W. C. Nahom III <br /> Etal. If there is no progress to correct this violation within the 5 day period, the City is Authorized <br /> to proceed with abatement of the problem and the contractor costs along with an administrative <br /> fee of$185.00 will be split between the responsible owners. <br /> It is recognized that the oil deposit on the property may require a lengthy process to bring the <br /> property into compliance. The property owner is required to contact San Joaquin Public Health <br /> Services and demonstrate reasonable progress in correcting this violation within the 90 day <br /> period_ <br /> The property owner is to see that the property is maintained according to the Stockton Municipal <br /> Code standards. <br /> //,Cā <br /> Anthony <br /> Tren usso, Hearing Officer Dated <br />
