HMBP inspector helped operator create a contingency plan <br /> and submitted to CERS account. <br /> REGULATION GUIDANCE: <br /> (a)Each owner or operator shall have a contingency plan for the facility.The contingency plan shall be designed to <br /> minimize hazards to human health or the environment from fires, explosions, or any unplanned sudden or <br /> non-sudden release of hazardous waste or hazardous waste constituents to air, soil, or surface water. <br /> (b)The provisions of the plan shall be carried out immediately whenever there is a fire, explosion, or release of <br /> hazardous waste or hazardous waste constituents which could threaten human health or the environment. <br /> CORRECTED ON SITE. <br /> This is a Class II violation. <br /> 114 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. <br /> OBSERVATION: Designated facility signed copies of Uniform Hazardous Waste Manifests(UHWM)were not <br /> found on-site. <br /> Note: Operator could not provide any uniform hazardous waste manifests for the past three years, 12-9-2016 to <br /> 12-9-2019. <br /> REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br /> with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility <br /> which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br /> waste was accepted by the initial transporter. The hazardous waste generator must submit an exception report to <br /> the California Department of Toxic Substances Control (DTSC)within 45 days if the destination facility signed <br /> manifest copy is not received from the transporter or designated facility. <br /> CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests for hazardous waste including <br /> used oil, used antifreeze, oily solids, and used oil filters and send a copy to the San Joaquin County Environmental <br /> Health Department(EHD). If the destination facility signed manifests cannot be found then prepare an exception <br /> report for each missing manifest as required by Title 22 California Code of Regulations section 66262.42.
