ENVIRONMENTAL OVERSIGHT AGREEMENT <br /> FOR THE REDEVELOPMENT AGENCY OF THE CITY OF STOCKTON <br /> CONTRACT NO. <br /> 1. INTRODUCTION <br /> This Environmental Oversight Agreement (Oversight Agreement) is made between the <br /> Redevelopment Agency of the City of Stockton (Redevelopment Agency), 425 N. EI <br /> Dorado, Stockton, California 95020, and the California Environmental Protection <br /> Agency, Department of Toxic Substances Control (DTSC). The Parties intend, by this <br /> Oversight Agreement, to establish a mutually beneficial working relationship and to <br /> cooperatively address Brownfields properties in the West End Redevelopment Project <br /> Area in the City of Stockton. The Redevelopment Agency and DTSC both share the <br /> mission to revitalize and reuse Brownfields properties to address known or perceived <br /> environmental contamination in order to provide significant benefits to the economy and <br /> health of surrounding communities. DTSC is committed to working in partnership with <br /> communities to restore contaminated properties to productive use, while ensuring that <br /> cleanups are protective of public health and the environment. The Redevelopment <br /> Agency intends to eliminate blight by constructing infrastructure and public facilities, <br /> promoting improvements in commercial, industrial and residential areas, removing or <br /> alleviating the negative effects of hazardous substances, and improving, increasing and <br /> preserving the community's housing stock. <br /> This Oversight Agreement outlines a Scope of Work and a broad approach for DTSC to <br /> provide technical consultation and remediation oversight support. The intent of the <br /> Oversight Agreement is to establish a collaborative process that: <br /> 1 . Provides a flexible process based upon the Redevelopment Agency's <br /> needs for a project; and <br /> 2. Ensures the investigation is conducted in an environmentally sound <br /> manner. <br /> For the Property covered by this Oversight Agreement, the Redevelopment Agency has <br /> proposed a Scope of Work that it believes addresses its particular needs depending on <br /> whether the Redevelopment Agency is seeking (1) only technical consultation from <br /> DTSC, or (2) DTSC assistance in cases where the Redevelopment Agency intends to <br /> proceed under the Polanco Act, Health and Safety Code section 33459 et seq., or other <br /> applicable laws as determined appropriate by DTSC (Exhibit C). The Redevelopment <br /> Agency may request, and pay for DTSC services without any commitment to move <br /> forward with a project, a Property or a group of properties, and may request early <br /> consultation with DTSC, where desirable. <br /> 1 .1 . Purpose of Agreement. The purpose of this Oversight Agreement is to <br /> specify the process that will be used to evaluate the Property under this Oversight <br /> Agreement-, and to provide a framework for the reimbursement of DTSC's oversight <br /> 2of31 <br />
