Several responsible <br /> parties (RPs) are conducting soil and groundwater investigations and interim remedial measures at Parcel <br /> 2A under the oversight of Regional Board staff. hi addition, the RPs are preparing a Health Risk <br /> Assessment and conducting public participation activities under the oversight of the Department of Toxic <br /> Substances Control. The RPs are making satisfactory progress in the ongoing work. <br /> Since satisfactory progress continues and responsibility for pollution cleanup under the Water Code is <br /> joint and several, we have not asked any other RPs to conduct investigation or cleanup at the site. <br /> However,based on the information provided, if the Regional Board issued a Cleanup and Abatement <br /> Order for the site, the Stockton RDA would be named as a Discharger under the Water Code and <br /> responsible for the cleanup of discharges of petroleum at Parcel 2A, as further explained below. <br /> Therefore, the Regional Board requests the Stockton RDA to submit any technical information it may <br /> have regarding its activities on Parcel 2A related to the petroleum facilities, specifically information <br /> related to the dismantling of the L&M Petroleum facilities. The Stockton RDA may present additional <br /> information regarding its role for the Regional Board's consideration. <br /> The information on the Stockton RDA's involvement with Parcel 2A is contained in a 29 September <br /> 2003 letter(Letter) submitted by the Law Offices of Robert C. Goodman on behalf of the Chevron <br /> Environmental Management Company and ConocoPhillips, two of the responsible parties for the L&M <br /> Operable Unit of Parcel 2A. The Letter, a copy of which is enclosed, includes copies of the following <br /> documents: <br /> • 19 July 1982 Agreement for Purchase and Sale of Real Property between the City of Stockton <br /> Redevelopment Agency(RDA) and the principals of L&M Petroleum; <br /> • 19 July 1982 Grant Deed, transferring the property to the Stockton RDA; <br /> California Environmental Protection Agency <br /> Zd Recycled Paper <br /> The energy challenge facing California is real.
