Jahant Rd Py _. 1
Acampo, CA 95220
Re: SB 2004 Cleanup Fund Eligibility
Dear Mr. and Mrs. Grenz:
The State Water Resources Control Board (SWRCB) has responded to
our request for clarification of the eligibility for the SB 2004
Clean- up Fund of previously exempt farm tank owners. Enclosed is
a copy of the SWRCB letter.
As noted in the letter, recent legislation (AB 1699) placed
conditions on SB 2004 eligibility which are retroactive to January
1, 1985. Specifically the letter states that whether or not farm
tank owners complied with closure and operating permit requirements
when they discontinued use of a tank for agricultural purposes,
they are not eligible for the Fund if the tank was located on
agricultural property on or after January 1, 1985. The letter
further states that a change in the law would be required in order
to allow tank owners in your situation to participate in the
Cleanup Fund. ,
It is our recommendation that you contact your legislative
representatives and request their assistance in this matter.
You may also wish to discuss this matter with legal counsel.
Please contact me at (209) 468-3450 if you have any questions or if
I can be of further assistance.
Jogi Khanna, M.D. , M.P.H.
Health icer
aurie A.
