After a careful
review, we have concluded that home heating fuel tanks, which are exempt by
virtue of use, retain their exemption upon closure. Only when a farm or home
heating fuel tank changes from an exempt use to a regulated use does it become
subject to the UST law, therefore we will revise our regulations and guidance to
reflect this interpretation of State law.
Thank you for bringing your concerns to our attention. If you have any further
questions about this matter, please telephone Harry M. Schueller, Chief,
Division of Clean Water Programs at (916) 739-4332.
Sincerely,
ORIGINAL SIG14L11 K
Walt Pettit
Executive Director
