Birkie : <br /> EXTERNAL PROGRAM REVIEW RECOMMENDATIONS REGARDING THE UST PROGRAM <br /> Thank you for your letter of September 27, 1.995 to John Caffrey, <br /> Chairman of the State Water Resources Control Board, concerning a <br /> recommendation made by the External Program Review Committee <br /> regarding an informal dispute resolution process for UST cases . <br /> Mr. Caffrey has asked me to respond to your concerns . Your <br /> experience with a particular site in San Joaquin County appears <br /> to have prompted your letter. Before I discuss the Committee' s <br /> specific recommendation, I would encourage you to communicate <br /> with Lori Casias of our Underground Storage Tank Local Oversight <br /> Program concerning specific problems you may be experiencing with <br /> San Joaquin County' s handling of this site . Ms . Casias can be <br /> reached at (916) 227-4325 or PO Box 944212 , Sacramento, 94244- <br /> 2120 . <br /> As you are aware, on July 31, 1995, Mr. Caffrey responded to a <br /> similar concern expressed by Ms . Jeanne M. Zolezzi of your law <br /> firm. Let me elaborate on that response . That letter described <br /> the petition procedures outlined in SWRCB Resolution No . 88-23 . <br /> Those procedures allow the appropriate regional board to provide <br /> a response to any petition submitted to the State Board. In <br /> addition, our Local Oversight Program contracts include language <br /> that allows a local agency to develop an informal dispute <br /> resolution process, which may include regional board review and <br /> assistance, if the agency wishes to do so . For sites under the <br /> jurisdiction of a Local Oversight Program agency, the responsible <br /> party should initially contact the local agency to arrange a <br /> meeting to discuss any dispute. If the responsible party and the <br /> local agency are unable to resolve the dispute, the local agency <br /> could request assistance from the regional board. Without <br /> knowing the specific facts of the case you refer to in your <br /> letter, I can only assume that the regional board directed you to <br /> file a formal appeal with the State Board because they had not <br /> been contacted by San Joaquin County for assistance with the . <br /> site .
