You have suggested in your letter of July 5 ,
1994 , and our subsequent telephone conversation that no
extension had been granted. To suggest that when neither
you nor your supervisor were even in the office to review
the CAP report if it hadn' t been submitted nor to deny any
request for extension is difficult to understand. The
purpose of my letter to you was to inform you of a problem
and to tell you when it would be cured. Since today is
your first day back from vacation and only the second
working day after the deadline, submittal of a CAP should
not disadvantage the County or our client in achieving the
goal of cleaning up the site. In fact, again, we don' t
quite frankly understand how submittal of an admittedly
incomplete report to you on a day when you were not there
to receive or review it, is better than submission of a
corrected report to you upon your return. However, no one
has been harmed and the intent of time of cleanup has been
furthered.
I am very sorry Linda, that we seemed to have gotten at
loggerheads in this and I wish to reiterate again, that we
do not wish to be at loggerheads and in fact, are
addressing this problem with the consultant. As I have
mentioned in my letter, a time line has been set so that
any future delays are avoided. As I mentioned, we all are
concerned that efforts are taken to avoid jeopardizing the
status of SB 2004 Funds. These funds are essential for
clean up of the site and a two day delay is a poor reason
F:\TRN\19159\C\EKHOLZZ.BKB
22968-19159/jLk/07/05/94/1
