Kelly Drive <br /> Lodi, CA 95240 <br /> Re: Concerns with PHS-EHD: 1) UST Cleanup Billing Procedures <br /> 2) Hazardous Waste Inspection Activities <br /> Dear Mr. Bietz: <br /> During the Lodi Chamber of Commerce Industrial Committee meeting on March 10, <br /> 1993, you expressed particular concern with the above issues. We have reviewed our <br /> records and hope the following information will explain our agency's involvement in <br /> these activities. <br /> 1} Billing from our office associated with your underground storage tank (UST) <br /> cleanup was very untimely and charges for the same time period were billed <br /> several years apart. <br /> Our agency signed a contract with the State Water Resources Control Board <br /> (SWRCB) in March 1989, which granted us authority to oversee UST cleanup <br /> activities. Under the terms of this contract, our office would bill the SWRCB <br /> for "site specific" (staff time spent on a particular cleanup project) and <br /> "program management" (non-site specific staff time, supervisory and clerical <br /> time and the direct costs of services and supplies) costs. The SWRCB would <br /> then bill the individuals/businesses responsible for performing the cleanup. <br /> Because this was a 100% cost recovery program, the bill sent by the SWRCB <br /> would include both the local agency charges and a proportional cost (based on <br /> the actual site specific hours for a site) for state agency costs for the UST <br /> cleanup program. <br /> Our staff began oversight of UST cleanup activities at your site in October of <br /> 1989. At that time, we sent you a notification letter explaining that bills for <br /> oversight charges would come from the SWRCB and not our office. A little <br /> over a year later, in November 1990, the cleanup oversight was completed and <br /> a closure letter was sent.
