1 .t <br /> 4 <br /> 86 Sunday,August 15, 1999 f n <br /> z' <br /> DA sues <br /> Arco over <br /> . 11 gas tanks' <br /> ,p <br /> up rade <br /> Associated Prean <br /> STOCKTON—The San Joaquin <br /> County District Attorney's Office <br /> has filed a $10 million lawsuit <br /> against Atlantic Richfield Co. and <br /> several of its' local gas stations, <br /> claiming that underground fuel <br /> tanks were riot upgraded as re- <br /> by law. <br /> The suit, filed Friday in San <br /> Joaquin Superior Court, also al- <br /> feges unfair business practices be- <br /> cause the tanks were not up- <br /> graded. The suit involves eight <br /> Arco stations. <br /> "It's only fair that businesses <br /> that fail to come into federal corn- <br /> pliance have ,enforcement action. <br /> initiated," Deputy District Attor- <br /> ney David Irey said. <br /> All single-walled fuel tanks <br /> i were to be removed by Dec. 22 or <br /> r ' Y ..fines of$11,000 per day per viola- _. <br /> tion would result. Fuel was to be <br /> delivered only,to stations with up- <br /> graded tanks as of Jan. 1. <br /> Arco spokeswoman Linda Dozi- <br /> er said she was not aware of the <br /> lawsuit and would not comment <br /> further. <br /> In April, the company said that <br /> four stations had been temporari- <br /> ly shut down because of problems <br /> getting the new tanks installed <br /> and certified. <br /> According to the lawsuit, own- <br /> ers of five Arco stations in Stock- <br /> ton,as well as stations in Lathrop, <br /> Manteca and i Lodi, operated un- <br /> derground tank systems without a <br /> permit and failed to repair or up- <br /> grade the systems_ <br />
