The Conditions of Approval are all based upon ordi- <br /> nance requirements and are , therefore, appropriate in their impo- <br /> sition. <br /> In response to this appeal , the Council of Governments provided <br /> the following information which indicates that the condition is <br /> both appropriate and legally authorized: <br /> "The authority to request such conditions stems from Section <br /> 21670 of the California Public Utilities Code, which spells <br /> out the intent of the State ' s airport planning law. More <br /> specifically, it charges the Commission with the respon- <br /> sibility to ' . . . provide for the orderly development of each <br /> public use airport . . . and the area surrounding such <br /> airports, . . . promote the overall goals and objectives of the <br /> California airport noise standards adopted pursuant to <br /> Section 21669 (of the Public Utilities Code) , and prevent the <br /> creation of new noise and safety problems . . . to protect <br /> public health, safety, and welfare by ensuring the orderly <br /> expansion of airports and the adoption of land use measures <br /> that minimize the public ' s exposure to excessive noise and <br /> safety hazards within areas around public airports to the <br /> extent that such areas are not already devoted to incom- <br /> patible uses. '" <br /> ENVIRONMENTAL CONSIDERATIONS : <br /> An Initial Study was prepared for this project on May 1 , 1989, <br /> and no significant effects on the environment were identified. <br /> On the basis of that review, a Negative Declaration was prepared <br /> for this project . <br />
