Ray-Mar Farms is a heifer raising facility. The ROWD was comprised of <br /> a Form 200 and some additional information. On 31 July 2002, Regional Board staff sent a letter to Mr. <br /> Ray Alger stating that the ROWD was incomplete due to insufficient information regarding waste <br /> management at the site. On 11 October 2002, a revised Form 200 and additional information were <br /> provided to Regional Board staff during an inspection of the facility under construction. <br /> The revised ROWD adequately described the project, which will consist of calf hutches and four shade <br /> buildings to house 5900 calves to 3 months of age and 400 calves from 3 months to one year of age. The <br /> facility will have 2 settling ponds and 2 wastewater storage ponds. In addition, 300 beef animals will be <br /> grazed on pasture at the site for 7 months out of each year. The ROWD contained sufficient information <br /> regarding the wastewater generation, storage, and cropland application. The settling ponds and storage <br /> ponds have adequate capacity to store 180 days of manure generated, rainfall runoff, and a 25-year, 24- <br /> hour storm event. A nutrient management plan was also provided to document the application of liquid <br /> and solid manure to the cropland at the site. The revised Report of Waste Discharge adequately <br /> described the project and therefore is complete for state requirements. However, there may be additional <br /> requirements for your Federal Permit, as explained below. <br /> On 12 February 2003, the Concentrated Animal Feeding Operations (CAFO) Final Rule developed by <br /> the United States Environmental Protection Agency was published in the Federal Register. The <br /> regulations contained in the final rule were effective 14 April 2003. Your facility appears to have <br /> sufficient animals to be identified as a CAFO; therefore, you have a duty to apply for a National <br /> Pollutant Discharge Elimination System (NPDES) permit from the Regional Board. We are in the <br /> process of drafting a general NPDES permit for the Regional Board's consideration in a public hearing. <br /> When the Regional Board adopts a general NPDES permit, staff will inform you of your obligation to <br /> apply for this new federal permit.
