The proposed dedication of land or improvements to the County <br /> is consistent with the General Plan because no dedications or <br /> improvements are required. <br /> APPEAL : <br /> On March 6 , 1989, John Roland Jordan, Jr . , one of the owners, <br /> appealed the Planning Division' s denial . <br /> BASES FOR APPEAL: <br /> Mr . Jordan gave the following as his bases of appeal : <br /> "The City of Stockton will serve both lots with sewer upon <br /> request . We have filed with LAFCO for annexation. The City <br /> of Stockton Fire Department finds the proposed access both <br /> safe and reasonable, and their signed approval was forwarded <br /> to Planning prior to referral mailing. <br /> "The lot split creates a legal lot which is landlocked. We <br /> have secured an easement which allows access to the property <br /> from an existing private road. This is a unique situation, <br /> and we feel deserving of further consideration. " <br /> ANALYSIS OF APPEAL: <br /> Services and Annexation: <br /> The City of Stockton Department of Public Works has indicated <br /> that sewer and water services will be provided upon annexation <br /> to the City of Stockton and subject to four conditions (see <br /> "Referrals and Replies" ) . Under Section 9-10201 (a) and <br /> 9-10101 (a) , sewage disposal and water, provided by existing <br /> agencies, are required for approval of a Minor Subdivision. <br /> A "will serve" letter from the City of Stockton which states <br /> that the City has the capacity and is willing to serve both <br /> proposed lots with public water and sewer service is required <br /> before a Minor Subdivision application can even be processed. <br /> The City of Stockton will not provide services while the pro- <br /> ject is in the County. Therefore, a Minor Subdivision is not <br /> possible under the jurisdiction of San Joaquin County. The <br /> applicant has the option of applying for a Minor Subdivision <br />
