The Navy has <br /> stated that OWSs are permitted under RCRA under the conditionally exempt tier. We agree that DTSC <br /> has authority to require the Navy investigate OWSs under the RCRA program. The Board has separate <br /> authority to protect waters of the state which is clearly stated in the Water Code and the Region's water <br /> Qualim Plan (Basin Plan). As stated in our letter of 2 June 1998, we also have authority over these <br /> OWSs under the CERCLA program. <br /> We are pleased to hear that the Navy is pursuing an investigation of OWSs prior to transfer or lease of <br /> the property to the Port of Stockton. Based on our review of the documents, we provide the following <br /> comments: <br /> 1. The report does not list the constituents of potential concern (COPC) for sampling and analysis. <br /> We request that TPH and BTEX (volatiles) be sampled in the soil and groundwater, as appropriate. <br /> 2. Based upon the `typical drawing for oil water separators' with illustrated sampling locations, we <br /> further request that a sample also be taken next to the wash rack/sump. <br /> If you have any questions, please call me at (916) 255-3078 <br /> KIM A.
