Investigation commenced in 2001 <br /> and identified low levels of chemical constituents that have since decreased to below water quality <br /> objectives in the monitoring wells. The attached Memo provides additional details. The Regional Water <br /> Board concurs with the Dow Chemical Company that the remaining residual concentrations of site <br /> constituents do not pose a threat to human health, the environment, or waters of the State. <br /> Dow Chemical Company has satisfactorily completed site investigation and achieved applicable <br /> remedial action standards and objectives at the Dow Chemical Facility. Therefore, no further action is <br /> required. This No Further Action Determination is not effective until after Dow Chemical Company <br /> submits the necessary documentation of the destruction of the monitoring wells, in accordance with all <br /> applicable County and State requirements. Once proof of appropriate destruction has been received, <br /> Regional Water Board staff will send written confirmation of the effective date of this Determination. <br /> Issuance of a No Further Action Determination does not preclude future action by the Regional Water <br /> Board if subsequent monitoring, testing, or analysis at the Dow Chemical Facility indicates that the <br /> remedial action standards and objectives were not achieved; a new or previously undiscovered release <br /> occurs at 400 West Gandy Dancer Drive in Tracy; new information indicates that further site investigation <br /> and remedial action are required to prevent a significant risk to human health and safety, the <br /> environment, or water quality; or the Dow Chemical Company induced the Regional Water Board to <br /> issue this No Further Action Determination by fraud, negligent, or intentional nondisclosure or <br /> misrepresentation. <br /> If you have questions about this letter, you may call Nathan Casebeer at (916) 464-4665. <br /> PAMELA C.
