Entities from or sent by the Chevron Entities to any Governmental Authority in relation to the <br /> Work. In addition, Chevron shall use commercially reasonable efforts (i)to give Catellus prior <br /> notice of the intention of any of the Chevron Entities to initiate and engage in face-to-face or <br /> telephonic substantive discussions regarding the Work with any non-clerical representative of <br /> any Governmental Authority(generally, a"Governmental Representative"), and Catellus shall <br /> have the right to participate in such substantive discussions, and (ii) to promptly notify Catellus <br /> of the occurrence and content of any unwritten substantive communication regarding the Work <br /> initiated by a Governmental Representative. Conversely, Catellus shall use commercially <br /> reasonable efforts (x) to give Chevron prior notice of Catellus' intention to initiate and engage in <br /> face-to-face or telephonic substantive discussions regarding the Work with any non-clerical <br /> representative of any Governmental Authority, and Chevron shall have the right to participate in <br /> such substantive discussions, and(y) to promptly notify Chevron of the occurrence and content <br /> of any unwritten substantive communication regarding the Work initiated by a Governmental <br /> Representative. <br /> 5. Insurance. Chevron hereby represents and warrants to Catellus that Chevron is <br /> self-insured with respect to its duties and liabilities hereunder. Nevertheless, prior to any entry <br /> upon the Property or commencement of the Work, Chevron shall submit to Catellus reasonably <br /> acceptable evidence of the provision and maintenance of insurance coverage in the following <br /> amounts covering the actions or omissions of Chevron's contractors, subcontractors, consultants, <br /> and subconsultants with respect to the Work: <br /> (a) Commercial General Liability Insurance(Occurrence Form). For each <br /> contractor or consultant, not less than Two Million Dollars ($2,000,000)per occurrence and not <br /> less than Five Million Dollars ($5,000,000) in the aggregate. For each subcontractor or <br /> subconsultant, not less than One Million Dollars ($1,000,000)per occurrence. Catellus shall be <br /> named as an additional insured under all policies required by this subsection. <br /> (b) Comprehensive Automobile Liability Insurance. For each contractor or <br /> consultant,not less than Two Million Dollars ($2,000,000) per occurrence. For each <br /> subcontractor or subconsultant, not less than One Million Dollars($1,000,000)per occurrence. <br /> (c) Workers' Compensation and Employer's Liability Insurance. Workers' <br /> compensation insurance that fully complies with all state and federal statutory limits, as well as <br /> employer's liability insurance in the amount of not less than One Million Dollars($1,000,000) <br /> for each contractor or consultant and not less than Five Hundred Dollars ($500,000) for each <br /> subcontractor or subconsultant. <br /> (d) Professional and Contractors' Pollution Liability Insurance. For each <br /> contractor or consultant, not less than Five Million Dollars ($5,000,000) combined each loss and <br /> annual aggregate. For each subcontractor or subconsultant,not less than One Million Dollars <br /> ($1,000,000) combined each loss and annual aggregate. Catellus shall be named as an additional <br /> insured under all polices required by this subsection. <br /> (e) Primary Covera e. All insurance to be maintained by Chevron's <br /> contractors, subcontractors, consultants, and subconsultants with respect to the Work shall, <br />
