PERMIT/SERVICES <br /> 333 West EI Camino Real, Suite 240 <br /> Sunnyvale, CA 94087 <br /> CONDITIONAL NO FURTHER ACTION DETERMINATION, THE LANDING SHOPPING <br /> CENTER, 3422 WEST HAMMER LANE, STOCKTON, SAN JOAQUIN COUNTY <br /> Investigations conducted at the Landing Shopping Center in 2000 indicated trace concentrations <br /> of PCE in groundwater that are below water quality objectives. The attached Memo provides <br /> additional details. The California Water Quality Control Board, Central Valley Region (Central <br /> Valley Water Board) concurs that the remaining residual concentrations of site constituents do <br /> not pose a threat to human health, the environment, or waters of the State. <br /> The site investigation has been satisfactorily completed and applicable remedial action <br /> standards and objectives have been achieved at the Landing Shopping Center, 3422 West <br /> Hammer Lane in Stockton. Therefore, no further action is required. This No Further Action <br /> Determination is not effective until after Hammer Landing, LLC submits documentation of the <br /> destruction of the site investigation monitoring wells, in accordance with all applicable County <br /> and State requirements. Once proof of appropriate destruction has been received, Central <br /> Valley Water Board staff will send written confirmation of the effective date of this <br /> Determination. <br /> Issuance of a No Further Action Determination does not preclude future action by the Central <br /> Valley Water Board if subsequent monitoring, testing, or analysis at 3422 West Hammer Lane <br /> indicates that the remedial action standards and objectives were not achieved; a new or <br /> previously undiscovered release occurs on 3422 West Hammer Lane; new information indicates <br /> that further site investigation and remedial action are required to prevent a significant risk to <br /> human health and safety, the environment, or water quality; or the Central Valley Water Board <br /> was induced to issue this No Further Action Determination by fraud, negligent, or intentional <br /> nondisclosure or misrepresentation. <br /> If you have questions about this letter, you may call Nathan Casebeer at (916) 464-4665. <br /> Ver OAMELA C.
