As you can see, I visited the site yesterday and sent the e-mail that you see below, to the <br /> Environmental Manager (EM) of the Company today. <br /> Hi Andrew—Yesterday, October 28, 2009, I visited the subject property hoping to find Mr. Terry <br /> Loeser, the manager on-site and wanting to ask questions regarding a referral we received that the <br /> Learner Company may have disposed waste at the property. As I found, there was no one on site and <br /> the gate was locked. This morning, I contacted Mr. Loeser by telephone and he asked me to direct all <br /> questions regarding the property to you. <br /> Mr. Loeser stated that you have received a"release" from the County of San Joaquin, and that you are <br /> currently working with DTSC regarding some aspects of the operation you may have had at the site and <br /> clean up issues. The nature of the referral we received was that the company was closing the operation <br /> after 30 years and may be disposing waste on the property by landfilling. Various types of heavy <br /> equipment were observed on the property, that may have been used to excavate large pits for the <br /> disposal of solid waste on the property. <br /> Since, as you know, the CIWMB is the designated Enforcement Agency (EA) for all issues related to the <br /> handling and management of solid waste within the City of Stockton, please submit a written report, <br /> within 15 days, to address the allegation of the disposal of solid waste at the subject property. If you <br /> deem that the matters of the property and the waste handling activities on the property are within the <br /> jurisdiction of the DTSC, please forward to us the names, address, and telephone number of the DTSC <br /> (and/or San Joaquin County) contacts that you are working with on the project. <br /> I just got a call from the EM, assuring me that no solid waste was disposed on the property and that <br /> they will submit a full written report of the cleanup activities they have done, and of the work they are <br /> doing with DTSC. On August 6, 2009 1 was performing a Routine Waste Tire <br /> Inspection at the Learner Company located at 2711 Navy Dr., in Stockton 95206. The <br /> Learner company recycles scrap iron and steel, the Manager onsite Terry Loeser told <br /> me that the company is closing after 30 years of buisness. During the inspection <br /> I observed what looks like The Learner Company is disposing some of the waste by <br /> 11/16/2009 <br />
