Cleanup and Abatement Order No. <br /> 5-01-722 (Order) requires that MonierLifetile clean close the the waste piles at your French <br /> Camp and Lathrop facilities by 30 June 2006. The French Camp waste pile was closed in <br /> compliance with the Order and a closure report has been submitted. The bulk of the Lathrop <br /> facility waste pile has been removed with much of the the waste recycled to produce new <br /> concrete tiles. Staff understands that because of a slowdown in the roofing the market <br /> MonierLifetile has not been able to recycle all the Lathrop facility waste. Approximately, <br /> 30,000 cubic yards of the waste remain at the Lathrop facility. <br /> The San Joaquin County District Attorney's office previously extended the compliance date for <br /> removal of the Lathrop waste to 30 September 2007. Because the waste pile has been <br /> managed to limit storm water contact and there is no evidence of impacts from the waste to <br /> groundwater staff will not recommend enforcement of the 30 June 2006 closure date provided <br /> we see a continuing reduction of the Lathrop waste pile and it is clean closed by 30 <br /> September 2007. Please note that we are not revising the Order and if the Lathrop waste pile <br /> is not removed by 30 September 2007 then staff will recommend enforcement and any <br /> monetary penalties for noncompliance would be calculated from 30 June 2006. <br /> If you have any questions please call me at (916) 464-4626 or Ross Atkinson of my staff at <br /> (916) 464-4614. <br /> ,-victor J.
